Gulf Coast Artists Marketplace Platform Art Sales Rules
These rules outline the guidelines and requirements for selling art on Gulf Coast Artists. By participating
as a vendor on the Platform, you agree to comply with these rules.
1. Eligibility
1.1. Age Requirement: Sellers must be at least 18 years old or have the necessary legal capacity to enter
into binding contracts.
1.2. Account Registration: Sellers must register for an account and provide accurate and complete
information, including name, contact details, and payment information.
2. Artwork Requirements
2.1. Originality: All artwork must be original creations by the seller. Reproductions of other artists’ work,
stock images, or clip art are not permitted.
2.2. Intellectual Property: Artwork must not infringe on any third-party intellectual property rights,
including copyrights, trademarks, or patents.
2.3. Prohibited Content: Artwork must not contain any offensive, obscene, or inappropriate content,
including but not limited to hate speech, violence, or explicit material. Artwork that incites violence or
promotes discrimination is prohibited.
2.4. Granting Permission: By submitting your artwork to our platform, you grant us permission to
display and showcase your work on our website.
2.5. Artists Tax Responsibilities: Artists will need to add taxes to your sales prices, since the website will
not be collecting these at customer check-out. It is the artist’s responsibility to manage and remit any
applicable taxes related to your sales. We recommend consulting with a tax professional to ensure
compliance with all relevant tax regulations.
3. Listing Guidelines
3.1. Accurate Descriptions: Sellers must provide clear, accurate, and detailed descriptions of their
artwork, including dimensions, materials, and any relevant information about the creation process or
care of the artwork once received by the buyer.
3.2. High-Quality Images: Sellers must upload high-resolution images that accurately represent the
artwork. Images should be clear, well-lit, and show multiple angles, or a video, if necessary.
3.3. Pricing: Sellers are responsible for setting their own prices. Prices must be fair and reflect the value
of the artwork.
3.4. GCA Commission: A 25% percentage (non-refundable, in case of a return) of the sales price that the
Platform will retain from each sale made through the Platform.
3.5. Availability: Sellers must ensure that listed artwork is available for sale. If an artwork is sold outside
the Platform or becomes unavailable for any reason, the seller must promptly (same day) update the
listing to reflect this.
4. Sales and Transactions
4.1. Order Fulfillment: Sellers are responsible for packaging and shipping sold artwork in a timely
manner (no more than 5 days). Sellers must use appropriate materials to ensure that artwork arrives
safely and undamaged. If artwork arrives damaged, it will be up to the seller to determine what actions
are required to rectify the situation. Policies about returns needs to be clearly stated on the platform
and is the responsibility of the seller to comply.
4.2. Shipping Costs: Sellers must clearly specify shipping costs in their listings. If offering free shipping,
this must be stated in the listing.
4.3. Taxes: Sellers are responsible for determining and paying any applicable taxes on sales. The
Platform may provide tools to assist with tax calculations, but the seller is ultimately responsible for compliance.
5. Communication and Customer Service
5.1. Timely Responses: Sellers must respond to customer inquiries and communication from the
Platform in a timely and professional manner.
5.2. Issue Resolution: Sellers are responsible for resolving any issues with customers, including disputes, returns, and refunds, in accordance with their policies spelled out on their platform. (It is the seller’s responsibility to create these policies.)
6. Compliance and Enforcement
6.1. Adherence to Rules: Sellers must adhere to all Platform rules and guidelines. Failure to comply may
result in warnings, suspension, or termination of the seller’s account.
6.2. Reporting Violations: Sellers and buyers are encouraged to report any violations of these rules to
the Platform for investigation.
6.3. Platform Rights: The Platform reserves the right to remove any listings, suspend accounts, or take any other necessary action to enforce these rules and maintain the integrity of the marketplace.
7. Prohibited Practices
7.1. Manipulative Practices: Sellers must not engage in any practices intended to manipulate or
artificially inflate their rankings, reviews, or sales.
7.2. Multiple Accounts: Sellers may not create multiple accounts to avoid limitations or mislead buyers.
7.3. External Sales: Sellers must not use the Platform to direct buyers to external websites or platforms for purchasing artwork outside the Platform.
8. Termination
8.1. Voluntary Termination: Sellers may terminate their account at any time by providing written 30 day
notice to the Platform and removing all listed artwork. (Termination will occur at the end of the billing
month)
8.2. Platform-Initiated Termination: The Platform reserves the right to terminate any seller’s account
for violations of these rules or any other reason deemed necessary to protect the integrity of the
marketplace. For example: If seller arranges custom work through a buyer on the Platform and sells it
outside of the Platform, this will be cause for termination. GCA will receive 25% for any custom work
that resulted from GCA platform.
8.3. Slander: Both parties covenant and agree that in no event, and at no time during the Term or at any
time thereafter, shall either of them disparage, denigrate, slander, libel or otherwise defame Gulf Coast
Artists or the seller’s business.
9. Changes to Rules
9.1. Amendments: The Platform reserves the right to amend these rules at any time. Sellers will be
notified of any changes, and continued use of the Platform constitutes acceptance of the revised rules.
10. Governing Law
10.1. Jurisdiction: These rules shall be governed by and construed in accordance with the laws of the
State of Florida, without regard to its conflict of law principles.
11. Indemnity
11.1. Indemnity: Seller agrees to hereby indemnify and hold Gulf Coast Artists, its heirs, executors,
administrators, assigns, or personal representatives harmless against any and all claims, suits or actions
of any kinds whatsoever for liability, damages, compensation or otherwise brought by Seller or anyone
on their behalf, including attorneys’ fees and any related costs. If litigation arises pursuant to any claims
made by Seller or anyone else acting on their behalf the non-prevailing party in any dispute under this
agreement shall pay all costs and expenses, including expert witness fees and attorney’s fees, incurred
by the prevailing party in resolving such dispute.
By selling on Gulf Coast Artists Platform, you acknowledge that you have read, understood, and agree to comply with these rules.
